Original Projects> RiskPlan Preventative Products

Focus GroupIt’s not enough to win your case. Legal cases create precedent. Legal cases create publicity. Legal cases create consensus and momentum. This translates into public opinion and political consequence. The RiskPlan tools allow companies and counsel to anticipate factors that could influence corporate and legal strategy and to make pre-emptive preventative decisions to shift the momentum in opinion and policy.

"Am I paying too much to settle this case?"
"Should I settle or go to trial?"
"What factors drive case value up or down?"
"What is my case worth?
"Which evidence, testimony and issues affect the worth of the case?"
"If I go to trial, how should I present the case to create the best result?"
"Which jurors will be good or bad for my case?"

Decision Analysis has developed RISKPLAN RESEARCH as a multi-dimensional assessment tool to answer these frequently asked questions and to arm legal teams with critical knowledge for settlement negotiations and jury trials. We design scientific research tailored to the specific events of the case, to derive a range of damages a jury would be likely to award and which evidence, testimony, demonstrative exhibits and overall case issues affect case outcome. This data is collected with the most advanced social science technology, analyzed, and presented with targeted, strategic recommendations in a customized report.

RiskPlan Research incorporates all the benefits of focus groups, mock trials, community surveys and venue research, plus offers insights to monetary damage risks.

With RiskPlan, we can:

• Balance the settlement value versus jury trial risks
• Assess possible case value
• Learn which evidence, testimony and issues drive case value up or down
• Identify and strengthen mitigating issues and circumstances
• Develop a jury profile and identify important voir dire issues
• Develop visuals to reinforce the case themes and story
• Use juror perceptions to create a clearer, more persuasive case presentation

Original Projects> Juror Comprehension Project

Case complexity often shapes jury verdicts. Jurors, when confused, resort to misconceptions and bias to interpret facts and the law. This research program pinpoints the case issues that lack clarity and provides needed context, background history, definition, and education to assist jurors in understanding and retaining the maximum amount of favorable information in the trial.

Original Projects> Information Architecture

While many trial organization programs coordinate the case evidence and law, this unique planning tool takes all of the information that could be potential decision influencers: community attitudes, emotional and educational issues, court procedures, personality profiles of parties and witnesses, jury selection and deliberation dynamics, trial presentations, legal precedent, testimony, and demonstrative evidence. This tool allows counsel to factor in and plan for all of the numerous variables that can affect trial outcome.
Original Projects> Simply Put: Language for Courtroom Comprehension

Words carry a case with clarity and power. Through testimony and argument, jurors and jurists alike put the case together through the language of the evidence and the law. This service develops the essential themes and story in a trial to create the greatest impact on the fact finder in addition to clarifying and simplifying the complexities that can distract a judge or jury.
Original Projects> Storyboarding the Case

Through television, movies, and computers, jurors learn and make decisions about the world through pictures. This unique service looks at the sequential story of the case and then renders it into pictures. By creating a storyboard or documentary of the case, we can develop graphic and demonstrative exhibits as well as visual language to serve as signal signposts for jurors to understand and retain the key elements in the case.
Original Projects> The Bias Project

Research shows how life experience and attitudes create the lens through which jurors view the case. This project studies the core opinions and beliefs that shape and determine evidence preferences, and develops the key case values that drive a verdict.
Original Projects> The Interactive Trial

Jurors understand what they hear, see, and experience . This service takes the evidence in the case and creates an interactive experience for the jury through models, tools, and demonstrations to maximize their essential experience and retention of the case evidence.
Original Projects> National Research – Phased Approach

Our proprietary research examines the central attitudes toward issues common to civil and criminal cases throughout the United States. Through database and survey studies, Decision Analysis looks at how jurors view product liability, anti-trust, corporate fraud, medical negligence, personal injury, intellectual property, toxic tort, and commercial case issues (among others) in venues across the country. This research allows us to look at jury opinion trends over time and study the primary opinions that are common to these cases. This allows counsel and companies to understand and strategically plan litigation into the future.
